HC breather for SGPC in ‘bunga’ possession case

Chandigarh : Acting on a petition filed by the Shiromani Gurdwara Parbandhak Committee (SGPC) in a case pertaining to Bunga Mazhabian adjoining ‘parkarma’ of the Golden Temple, the Punjab and Haryana High Court has stayed the execution of warrants of possession issued by the executing court — till the next date of hearing.
In the petition placed before the Bench of Justice BS Walia, the SGPC, through senior advocate Ashok Aggarwal and counsel Puneet Sekhon, had stated that a suit filed by the Ex-Military Mazhabi Sikh Association and other respondents for the possession of the ‘bunga’ (hostel for pilgrims) was decreed with regard to the property.
Thereafter, the decree holders (association) and others filed an execution application and sought issuance of warrants of possession. Instead of the execution proceedings being taken up in terms of the decree as per the site plan in the trial court record, it filed a site plan prepared by it and placed the same on record before the executing court. The executing court summoned the trial court file and orders. Its perusal revealed that the executing court proceeded with the execution proceedings in terms of the site plan placed on record by the decree holders, despite the fact that the trial court record was not received. It issued warrants of possession by rejecting the objection filed by the petitioner.
